Occupants not on the lease

    My apartment manager sent a notice today that my boyfriend and I, who are not on my brother's lease, need to be out within 24 hours. I have been very ill with cancer and my brother offred to let my boyfriend and I live with him. We have been here for nearly 5 months and have always been good residents. We have talked to the manager often about needed repairs or problems with neighbors and she has always polite. She has known for months that we were living here without being listed as occupants. She was, however, continually failing to make reasonable maintence repairs and when my boyfriend complained she became angry. She came to our apartment and actually screamed at us and slammed things around our apartment. It was very disturbing. Three days later we got this 24 hour notice, and we know the two are connected. We have no other option right now but to stay here. We are wondering what she can actually do to enforce this ultimatum. Anyone know?

    Depending just where you are, different things are possible. You are not on the lease and in many places you would be house guests. That's usually good for up to two weeks. She can start an action to have you removed. You have apparently received the notice, so if not out, you should expect to see a constable or someone serve you with a notice of a hearing. For that you may want to get an attorney. You may also be required to leave for renovation work. If the lease has a specified occupant and number of occupants, the person responsible for the lease my be in breach and also end up in an eviction action.
