breaking lease -
My tenant broke the lease,told me they're moving week later. I told them 45 days notice is proper thus, they're responsible for the rent up to those days. Yes? No? Some reason, my contract says 30 days I didn't correct it when we did contract but when I read tenant code, it says 45 days.
They also left damage, drapes was broken, door lock was broken, (automatic shutter lock on the top of the door that was mounted on), both bedroom closet doors were damaged and came off the track. It appears they forced to take it off to put a piece of shelving box in the closet and broke the door. They over loaded closet shelf and broke part of the shelving unit. Carpet was not shampoo or vacuumed, windows, bathroom were not cleaned, and freezer still had ice cream all over the shelving unit. nails were not pulled, broke off the ceiling fan light strings, and the fan blades were not cleaned. I told them I will be keeping deposit and bill them more if it took more for me to have the place cleaned and fix broken things. and are responsible for the rent upto May 19, (count of 45 days). they are demanding deposit and told me things were broken because they were old. Lock, closet doors, drapes were just been replaced before they moved in. What should I do? Pls. advise. Thank you!

Carpet was not shampoo or vacuumed, windows, bathroom were not cleaned, and nails were not pulled and the fan blades were not cleaned. this is all manager or landlord duties. all this should be done. make sure you take pictures of the damage. find the receipts of the new items you say you installed before these tenants moved in you can also take their deposit and bill them for the remainder of the ballance but are they likely to pay it? you may need to take them to small claims to sue. that cost a mini fortune to do so if the deposit covers most of the cost i.e doors,fan strings shelves id cut my losses and buy new curtians.
