Renter Rights – Things to do to Protect Yourself

If this is not acted upon…

  • Propose mediation with your landlord. There are independent agencies that will be able to hear both sides of a case and help the parties in the dispute come to a reasonable agreement.

If mediation fails to bring about a resolution…

  • Report your building and landlord to a local housing authority or building agency. Most often this agency can apply the needed pressure for your landlord to understand the importance of your issues and help rectify any problem.

Only when that fails should you…

  • Sue your landlord in small claims court. Not only might this damage the reputation of your landlord and the apartment property but if the lawsuit is financial in nature, it may also reflect NEGATIVELY on your credit report.

Only when all other attempts at mediation have failed should you take this drastic measure.

Look at your lease. He should NOT be able to come in and out WITHOUT your consent. YOu have the right to keep him out. I’m in CA, but I’m sure the laws are similiar.

I live in MN and the landlord or caretaker cannot enter your appartment without your permission. They have to let you know when they need to enter. Even if there is a repair.

NO! NO! NO! I have tenants in my mom’s home and the landlord (my mom) has a key to the apartment but we verbally told our tenants that we respect their privacy and would never enter their dwelling without their permission or knowledge. We only need the key(s) in case of an emergency - e.g flood, fire, gas smell etc. in case they are not home or god forbid they are asleep and unaware of what is happening. You can make a complaint to your county/state gov. housing or call your Councilman or Mayor. GOOD LUCK!

I was taking my L.L. to court for some repairs not being made & for him entering my apt. the day before he said he was going to. They have to give you at least 24 hr. notice or else make every attempt, within reason, to contact you. If unable to contact you, they may enter w/out permission as long as valid reason to (showing apt., making repairs, etc.) but they must provide written detail when, why they were there, all persons who entered the unit, & they must leave form in an inconspicuous loc. for you. They are allowed to enter at any time for emerg., pipes breaking, fire, etc. You can sue for $100 ea. time.

Yea, I know how you feel. My landlord comes over almost DAILY, for whatever reason he can think up. If he’s not ringing my doorbell or calling me on the phone, he’s hanging off the roof(literally, no joke) in my backyard.

no you need to look into your rental rights, it is not ok for your landlord to come in and check your apartment anytime he or she wants to. First they need to give at least 24 hrs notice before they enter into your apartment, no i think you might have a stalker nip it in the bud before he gets of of control

hello. hopefully you will be able to help me. i live in Carbondale, IL.
i was evicted from my apartment yesterday. no in’s and out’s, no partys, nothin. the story is, i ran to the store to buy some groceries. i get a call from a friend of mine who was at the apartment waiting for me to get back. supposedly, my landlord was fixing a fridge across the hall and smelled marijuana, so he knocked on the door and supposedly, my friend opened the door. the landlord then (not being invited inside) took it upon himself to step inside and kick everyone out. he then confiscated paraphenelia and a small amount of marijuana. he called the police and the police officer was hesitant to take the stuff. i talked to the officer, and he thought the landlord entering my apartment was bulls**t. i didnt recieve any tickets, so therefore no record. only the pictures and video he probably recorded.
any ideas?

hey they cant do that, they do no have the right to come into your house. ever after an eviction notice, they have to give you 30 days to get out, and they cant try ANY thing to get you out faster.

it is against the law for the landlord to enter the primacies with out any written consent. no matter what. nor can a police officer search your apartment without a legal court order search warent .
next he has to take you to court to legal evict you. and that process take at least 90 days. the judge has to order you to leave. if he put you out of your apartment. you can file for a civil suit in small claims court to get your security deposit back and the cost for your to relocate.
remember , its your word against his. it was illegal for what he did.
you could have easy said, or lied he broke into to your apt.

NO NO NO if that is not written in the lease anywhere they can’t. The cannot make you sign something saying that either at least til your lease is up. If they fine you do not pay it, If they throw you out sue them for breach of contract. You can break your lease for this as well if they do.

I have rented in several different apartments. I just recently signed our lease at our new place. I plan on moving in at the end of the month. I was told by the leasing manager that she would look over the lease and make sure nothing was missed. I could get a copy of the lease when we get the keys or stop by the office later. She also did not sign the papers at the same time we did. Should I be worried? I have always had a copy of the lease when we signed. A friend recommended this place. Any comments? Thanks.

I am going to sign a 1 year apartment lease today. The apt management is requiring a double deposit due to some dings on my credit report which I didn’t have a problem with until I googled the apartment and found that people posted web comments that the apartment management requires a double deposit for even people with excellent credit and charge move-out fees in excess of the deposit! Do I have a legal right to request in writing a list of any/all costs that will be deducted from my deposit at the time of move-out. And are they legally required to give me that in writing? My fear is that if I go into the lease signing tonight and seem pushy they will change their mind about renting to me and I have to be out of my current apartment by Monday!! Please advise.

Also, do I have the right to request to see a copy of or proof of the credit report they pulled on me? I payed an application fee that was supposed to be used for the purpose of the credit check but am uncomfortable with them charging a fee in lieu of a credit check if they haven’t indeed done one! Hey, I have the same problem.. It depends on who lived there the longest. See Some people like to just cause problems and if your landlord nows that they are just problem people then no other wise they could just not renew ur lease.

I am in an apartment in St Paul..I pay my rent on time and have been here since Aug of 06..Since moving in I have a problem with mice and roaches. I talked to other residents and they said this has been going on over a year. They are in my apartment spraying every month. I have talked to them about it many times. I even called the city inspector and he was out but I never heard what happened. Will another apartment rent to me if I break my lease. I have given them 7 months of trying to remedy this. oh, my goodness! I’ve been having the same problems. My apt was unfit to live in: bathrooms unsanitary, kitchen was horrible, ceiling fans were packed with dirt, etc. I was told that everything was gonna be cleaned before I moved in - it wasn’t. I have an exboyfriend who has been gone for three months.We both signed a lease together, now I need the landlord to take him off due to ex thinking he can still stay there he has no job nor is he paying for anything,also has drug problem, which landlord is aware of. The police were called and they made me leave my home and allowed him to stay there. I contacted the landlord and told him what the police did and he said it wasn’t right for the police to do that to me. landlord realizes the situation and tells me he will take ex off lease and make him leave, but tells ex in the same breath that he can stay as long as he needs to. what can I do? i’ve been in my apt since 4/05 and the lease went out in 5/06 we havent been able to pay them the whole payment in 3 mts and they still havent done anything and they still have to go to court to kick us out and then we have 30 day to move out and we dont have to worry about the deposit because they screwed up and now they can keep it.

My fiance and I moved into a duplex and shortly after we moved in(two weeks) the roof in our livingroom and bedroom started leaking. The landlord knew of the leak and did not disclose it when we signed the lease. He repaired the roof (so he says) after the leak by himself and now we are afraid that the roof is going to leak again. i need advise bad. I lived in an apt paid all my rent on time although i did have two months where there was a problem with my bank account however I did go to the office directly and pay again. I never had any cleaning charges when i moved out because I kept the apt clean and did such a good job when i moved out. I did fullfill my lease and had absolutely no problems with the complex. however now, 1 1/2 yrs after i moved out i received a call today telling me i am going to be going to court and my wages garnished for 3 months of rent they say i didnt pay. when i moved in i asked for receipts when paying rent, however they advised me they didnt give receipts. so the only proof i have is where i deducted the money for rent from my bank acct on the 1st of every month. If i was the type of person to not pay rent they would have evicted me…i dont know what my rights are and how to get all this solved since it was so long ago. i do not owe this money at all and the collections company keeps trying to get me to do a settlement…any advise??

i paid what i owed within two months of breaking lease. thinking it was done with i threw the reciepts away after a yr. they haven’t tried taking me to court but they sent me to the collection agencies–screwing up my credit bad. the thing is–in court it is up to you to prove your case to the judge. if they say you owe it and have where you broke lease and you have no proof otherwise then you will more than likely have to repay it and court cost. a bank stub is NOT proof. collection agencies can’t make you settle and it may not go to court–but if they do go to court it may be cheaper to settle now.

what can i do? i was renting in a house in diamond bar from two people who i have known for a few yrs. my friends were already renting from one of their friends who was the owner of the property. I did not sign any sort of lease. I had a cat there which they knew about from the very first discussion about their two extra rooms they had for rent. i was renting from them to help them out. Upon moving in all of a sudden he was allergic to my cat and he used this as the reason for him changing locks. After making the first month rent on time, seccond month the rent payment was late by 2 days which i warned them that would be the case. he punched a hole through my bedroom door. one week later they had changed the locks and i had paid in full on that 2nd day however i was now homeless and everything i owned was completely unavailable to me. I didn’t recover all my belongings for another two months due to them avoiding my calls and lying when they said they would be home. with no access to the home I had no way to hold a job, not to mention no where to stay and sadly no funds since i paid rent a week prior. The jerks were never there when we scheduled apointments to get my things. I finally found out the contact info to the homeowner. he then informed me he was going to evict them anyways and hat they had not paid him rent in like 3 months!!!!! i want my rent at least for the 3 weeks i actually paid for and never recieved…restitution for suffering the consequences they caused would be nice i have no idea what i can even do HELP!!

i have lived in the X apartments in sanger since november 17 2006. 2 weeks after i moved in i had plumbing problems and water heater broke. the manager refused to fix after 4 months i finally got fed up and called code enforcement to help, instead they favored owner and told me i have to move i am a single mother that went thru a separation.fresno unified school district help me with my deposit i have 7 children it was hard for me to find a place because of my credit i had a lot of credit cards i had everything consolidated and got screwed by the person that consolidated my bills she never payed my bills and i got behind 4 months on credit cards after my separation my husband would not pay his part so i had to let all that go because i lost my job after 15 years because of my husband threatening employees and myself so for the safety of my employees they had to fire me. i collected unemployment for 6 months and after i had to get on aid. i have always worked and took care of my family. i have been on aid for 7 months and i hate it because i have a hard time getting a job because i cant afford a babysitter and my teenage boys were out of control after separation. after all this im still standing strong and trying to do the best for my children. the owner of this apartment complex will not give me back my deposit because she is mad because of code enforcement bring involved she has other units available and can transfer me to another apartment but instead she said i have to leave and she has no other apartments. i think she is being unfair because in all the months i’ve been here i pay my rent on time and i still do. i think she is really unfair. i have to use a plunger everyday and i had to buy a vacumn to pick up water because my apartment got flooded i even had to throw my beds away and my new beds because everything got wet. i turned around and bought new beds and next thing you know i had mice and rats coming in through a hole left open in the closet the mice got in to my new beds i bought for my children and at night a rat jumped on my bed with my newborn baby and i sleep. i had to go to a friends house for the safety of my children. i had fans and airconditioning running day in and day out my p.g.e. bill was 250. a month i think she should help with that because i had to leave on due to everything getting wet.i cant even shower in my own home i had to pack all my stuff and have everything on chairs on table nothing can be on the floor. can someone tell me what can i do, i really need some kind of advice i dont have the money to just go. i can barely manage. with rent light laundry diapers and clothes for my children. please what can i do?

I have been living at these apartments six months. The first incident happened when I moved in with my lights. The people came to turn my lights on and The Complex did not have a meter. After that we did not have hot running water on three ocassions. The garabage disposer broke three times and they took a long time to fix it, My cabinet needed fixing it is molded and mildew and they said they are not going to fix it. My carpet is stained was stained when i got here thay will not clean or replace it. My refrigerator was not meeting tempertature and they brought one about one week later. When I put work orders in over the phone or in person they take a long time to fix the promblem.

I had a fire in my apartment due to a grease fire while I was cooking. The two fire extinguishers provided, (1 on each floor), for 8 apts. were not charged. It spread on the cabinets above the stove and I called 911. Insurance company is now trying to sue me for over $23,000.00 and the apartment building isn’t worth that much. I think he pocketed a good chunk of that. I was notified 4 years later, 11 days before the court date. I now live several states away. I can’t get there, can’t afford the retainer fee to get a lawyer in time. I guess I’m just a simple guy and was unaware of renters insurance. Oh, I heard of it, but I thought it was to insure my stuff and I had a lot of worthless stuff. Well, not worthless, but nothing that was of significant value. I never thought of a fire. Yeah, I know,should have got the insurance. But what do I do now? I’ve already called legal aid and since I now live in another state no one will accept me for pro bono or low income assistance there ’cause I no longer reside there. And no program here are licenced for any other state except for this state.

Get on public assistance food stamps or ssdi, by law they cant take that. be sure to transfer assets they can take to someone else, or throw your money overseas in a shell account.The only bad thing to come about this is a 10 year judgement. Claim Texas residency so they can’t garnish your wages. Use the UPS store for that.

This is in regard to my granddaughter who lives in the Penn Valley/Grass Valley area in the California Region 7. She is taking courses on line, working full time, and is trying to move into an apartment with her boyfriend. However, she has applied numerous times and has the deposit and first months rent available for the available apartment, but when she meets with them the next day they all tell her that the apartment has been rented. Just recently she took the time from work to get a cashiers check for the amount requested and then she was told that the apartment had been rented. This is her first experience with living in an apartmewnt. WHY IS IT SO DIFFICULT FOR HER?

I live in an apartment, where my neighbor smokes. It is driving us nuts! My daughter has asthma and she gets sick. I just found out that it is LEGAL for apartment managers and owners to make the apartments partially or completely smoke free!
I will be looking for smoke-free apartments from now on

Recently my family and I moved into an apartment while we are having a house built (our home we were in sold). Our experience started with me stepping in a HUGE pile of dog Poop. Residents are allowed pets and according to the directory they are responsible for cleaning up after their pets but this is definitely not the case. The third day that we were there the neighbors, upstairs toilet overflowed into our apartment. The office told my sister that it was a bathtub that overflowed. I had stepped in the 1-2” of water to throw towels down and clean the mess and then later in the day when maintenance had not yet returned I poked a bubble in the wall to drain the water which looked like amber colored urine. So when maintenance got there I asked what the water was from and he said that the toilet had overflowed a few times. Is the apartment complex (for health reasons) not responsible to at least tell tenants if urine and feces have possibly flowed into their apartment. It was like one or two inches of water on everything including the kids toothbrushes (got splashed). Then I go to turn on the air condition which did not work and within 5 1/2 weeks of living here I have had to call maintenance to fix the heat/air 5 times. Currently it is not working again. One of the times they interfered with something electrical that made the lights flicker and they had to come back to fix that also. We tried to open the bedroom window only to find out that there was no screen. We were promised to have a specially ordered screen within a week. We still have NO SCREEN. But, we did get a wasp nest in the window from opening the window without a screen. We have had a roach problem since moving in which come to find out according to the bug man is from heavy infestation above and below us. The manager said they spray our building once a week but how can they kill our roaches if they are not coming into our apartment? I have to keep calling every week to have it sprayed. Then my sons room was infested with ants in one corner that were crawling all in the carpet. I had to call the bug man back for that. The worst is that there are rotten window sills. My son’s room is the worst and you can just feel all around and tell that it is rotten. Not to mention that it smells moldy. It says to report mold right away. Well my husband called Monday and the property manager was supposed to get back to him about the windows… They did not even say if they would fix them and now it is Thursday with no call back. Tomorrow we have to call them back to fix the heat/air. Meanwhile, mold is an allergy for me and it puts a tightness in my chest. I really am not the type of person to complain. We came here just to have a simple, pleasant time while we build a home. This is not only terribly stressful, bad for our health, but also we lose A LOT of privacy because we are constantly having to call people to come into our apartment to fix things. I am a stay at home mom so we have to deal with them coming in whenever they show up and then we have to hold naps. It is just a pain. Is there anything we can do?

Hello to U Hopefully U can help me get a better clarification of this matter.My girlfriend and I have been living together for two years.We just recently move into a 3 bedroom duplex 2mnths ago,(it is in her name)but now she wants me out by the end of the month.It was about 2000 dollars to move,we agreed to split the cost but she only had 200 towards moving cost,I paid the rest.She can legally have the locks change and have me removed w/o paying me my money and w/o a 30 day notice to evict.Also we shared the cost of living expenses for 2 years.

What to do? My daughter went to work and when she returned found her mattress set, bedframe, clothes and carpet soaked! She contacted the management of the apartment complex and they stated that: It rained, the rain bypassed the over apartment from her, and the rain found it’s way and leaked from the ceiling to her bedroom below. How can that be? Management came in, dried the carpet (ceiling?), but did not state that they would replace her damaged property. Wouldn’t that be the management responsiblity if leakage came from the upstairs, be it rain or from a damage apartment above her? Who is responsible here?

My landlord never gave me any type of lease to me apt. When I came through here I had asked if there had ever been a past history of any pestisides. He told me no. Then I found out later that he had sprayed for them 2 months prier and the people downstairs are finding live ones. He sent in an exsterminator and he was spose to come back to check on the place but never proceeded to do so. Also the landlord agreed to come in once a week to see how clean the apts are, he never did so. I clean everyday, take trash out, wash dishes, vaccume, never leave food out and they came back again. Is there anything I can do about my landlord?!!!!

I have the same problem I can not afford to move again and I happen to like the sq. footage and location. However the office Mgr. is of no help and the Asst. Mgr has no pull. The head maint. man is a A-hole and refuse to do anything he doesn’t feel is needed. So what the hay can a person do especially when the Property Mgt. Company has no actual location or number to contact them. What then can a person do?

I have never had a problem with any landlord from whom I have rented,but some of these offences by both tenants and landlords have me so nervous that I do not think I will rent again from anyone.Some of the things listed seem downright disgusting and legally wrong. Pest control in a climate that is damp and humid can be much more of a challenge than the tenants and landlords can imagine.The close proximity of apartment living can produce some of the problems without anyone being really aware that they are all part of “pest control”.I am a registered nurse and I bring the hospital home with me so to speak, but most people are not equipped to deal with germs and pests or being demanding of their rights.This may be too much to state but if the management can see that you are overly anxious for their apartment, you are screwed before you have begun:Its like going to buy a car:

Depending on the state that one lives in there are different agencies and laws governing tenants rights and responsibilities. My daughter is having many problems at her apartment, thr latest being a sewage pipe that broke and ruiened some of her belongings. it has been 6 days and it is still not fixed. When she calls the apartment manager she never returns her calls. Today she had to take off from work to go see the apartment manager who was going to get in touch with the owner and call back but she hasn’t. I’ve lived int his aprtment for 2yrs and always paid my rent on time. For the last 6months i have been having trouble with my hot water in the bathroom i told the landlord to check it and he yes but never has i called the gas company in case it was a gas leak so they send someone out and it wasnt that so they told me i should call an inspector from the city so i did. The city’s safety code enforcement came and found about three pages of violations through out the apartment and gave them to the 25th of may to fix. One of the things they found was that i was paying light that belonged to the landlord so i asked him what was he planning of doing to fix that but he said he wasnt going to fix that because that wasnt his problem. I called the code enforcemnt again and they told me to hold the rent for this month until they re-inspected the apartment because if he didnt fix i would have to move so i did i holded the rent but now i got an eviction notice i have to pay the rent or leave the premises by the 29th of may. i have to little children 2 and 3yrs old and im a single mother. So if i give them the rent for this month but then the apartment doesnt pass i wont have money to get another apartment. I’m searching for another apartment now but i dont know what i should do about this month’s rent, can someone give me an advice

I have 30 years exp as an apartment manager. put you rent money in escrow or at least have it all in you account when you go to court..explani your situation to the judge…you will be ok just have the money and tel the judge that you are holding it for the repairs and you will be fine…If you dont have the money you will have a problem and risk eviction…

I spoke witha legal council and I was advised that the landlord CANNOT enter the unit without prior written notice or the tenant’s permission it is against the law and is a form of breaking and entering

I work for an answering service and several of the companies I answer for are property mangement companies. I only have one thing I’d like to add to this article:

If youre property mangement company or apartment complex has an answering service, please keep in mind that they are a company separate from the complex or mangement company. Often times they are doing everything they can to reach someone, and if they don’t respond there really isn’t much else that the answering service can do. So remember that it does NO good to yell at them. It just frustrates you more and then the answering service is not likely to want to help you anymore.

I live in my grandparents house. I know that it is old, but someone needs to be responsible for the repairs. The house belongs to my mom and my aunt. My sister is my mom’s advocate because she has Alzheimers. Neither one of them want to fix the central heat so I have to use space heaters. The central air works fine, but it has been sitting vacant for so long that iy needs cleaning. They don’t want to fix that either. We have a leak and it ruined the carpet and they don’t want to fix that either. I have no income and my friend that lives with me gets a small social security check. We have to pay rent and keep up the yard. My other relatives feel that we shouldn’t have to pay rent. It’s like pullimg teeth to get money to mow the lawn. My sister even tells us who we can and can’t have in the house. She is controlling and nosey. Good advise: Don’t rent from family.

I spent 9 months living in a 2 bdrm/2 bath at the XX. They units look nothing like the photos on the sites. The unit had bugs, mold, water damage. In 9 months there, my car was keyed, the washer broke, the stovetop broke, the oven broke, the heater in the main bedroom caught fire, the toilet broke, the laundry room door fell from pre-broken & not properly fixxed hinge and injured me. The neighbors above use their unit as a laundry matt all day and night. The walkway was damaged by salt when it snowed and never repaired after many requests. only 10 hours notice was given for the building water to be shut off for entire day, more than once. When it rained hard an amonia smell permiated the building making my family feel ill. In my opinion it is a slum and living there was a awful experience.

My wife & I are living in a 2 master bedroom apartment. THe first thing we notice was that one of the sliding doors of the closet is broken. We called the manager and she said that she’ll try to fix it. She sends the maintenance person but can’t fix it either because he says that the company who makes these kind of sliding doors don’t do them anymore. The place looks nice and clean, from the entrance all the way to the back. But when the complex was sold and bought by new owners & management was changed, everything went to ruins. Now if you enter from entrance it looks clean but when you go all the way to the back it looks dirty. Also, mice are starting to appear and the screen door is falling of the rails. We called the manager to report it and he says that it’s not his job to do those kind of things. The maintanance person is the one who suppose to fix it. The reason we call him because we don’t the phone number of the maintanance person.

I was going to say that I am relieved to see i’m not alone living in an apartment from hell but it actually made me more upset to here how many of us are being treated so bad. the apartment I live in with my mother was built on a landfill which is sinking in to the ground, my walls and ceilings have cracks in them, my shower is leaking from god knows where and going through the walls and the floor which is making my kitchen ceiling sag not to mention the water is running through the walls where my phone line is and through the ceiling where my kitchen light is, the electricity is from the 1960’s and needs to be redone in order to run the type of appliances that are being made now. all of my appliances run loud with humming and buzzing in the background they feel like and sound like they are getting to much electricity , not to mention that 3 televisions have sudenly stopped working properly or have just died 2 of them were brand new the ceiling that is falling down is falling on to my 220 wiring for my dryer which runs along the edge of the ceiling covered by metal piping which has water driping all over it , there is mold inside my kitchen cabinets from the pipes under the kitchen sink that is currently taped with 2 day priority tape and the windows are falling out not to mention my utility bills are sky high between the price increase and the fact that there are so many areas in my apartment that you can see the outside light through windows window sills around doors and lord knows where else. we are not able to store anything in the attic because the owners said that it isn’t sturdy enough. i have to go around the apartment atleast 2 times monthly to tighten screwws in all of my furniture and appliances because everytime a speeding or large vehicle hits the cracks in the road in front on my apartment the building shakes and things get loose,off balanced, unlevel or slide the owner sent letters to each tenant saying we were getting new windows and sidind made us remove things from walls and windows including blinds curtains and airconditioners only about 4 out of 49 apartments got new windows then the owner said they weren’t done right so she fired then workers in the meantime she never informed any of us that we werent getting windows or siding so eventually we put everything back up that was in november 2006 almost 7 months ago ther are even more things i haven’t mentioned because the more i type the more angry i become in closing i’ve been told nothing is wrong with my apartment, i complain too much and the best on of all july 1st the rent is being increased $50 a month and we cant afford to move i dont know if i need the homemakeover show, oprah winfrey or a shrink .well it was nice to get to complain to someone hope things work out for all of us bye

My roomate has left the country and bounced her rent check. She has been in and out of the country for the past year and a half which has honestly been great. She has failed to pay her rent of only $460 and her bank account was closed. I was served a a three day notice and will pay her portion because I don’t want an eviction on my credit. I have found a reliable roommate, who is a great friend and has perfect credit. How do I legally get my roommate off the lease since she’s abandoned her stuff, me and the responsibility of paying both our rents. I rented an apartment from a property management and paid them first, last and a deposit when I moved in. The air conditioner in he apartment was working great when I moved in 1 year ago, but now has quit working.The property manager said that it needed to be replaced and can’t be repaired and that the owner is all tapped out right now and says he don’t have to supply me with a cooling system only heating. I live in Bakersfield, California and right now in June it is 100 - 110 degrees. I also live in a town house with 2 teenagers who tend to fight with each other and me when it gets hot. See if you can contact the dept of health or whomever would know what to do about that situation. All I know is that if the conditions are severely different from how it was when you moved in, they should be responsible for keeping your way of life the same. Air conditioning is important when it’s 110 for god’s sake!!!! Check if you are allowed to hold the rent until that repair is made!!! The city should help with the answers!!! I’d tell them I am not PAYING RENT UNTIL THEY FIX!!!

Um, I would hold rent until they fix the air conditioning problem. Why should you sacrafice your health AND money in 110 degrees? Check with the city or a pro bono or free counsel and they can tell you if you are allowed to LEGALLY withhold rent for that problem.

Please help, I just moved into an apartment complex two weeks ago. And I am having a problem with the tenants upstairs from me keeping up to much noise over my head. I tried to talk with them to keep the noise to a minimum especially during the evening. They walk back and fourth most of lthe night and use their balcony as a dog house which I dont get to use mines. It smells like dog do and there is dog hair all over my balcony. i’m a resident of a senior citizen/mobility challenged apartment building in downtown detroit…the location is very nice BUT the building has major flaws that need to be addressed immediately like: no air conditioning in the building AT ALL, entry doors that are so heavy to open that everyone has complained to mgmt about it, maintenance calls that are either dealt with in a less than timely fashion or ignored totally, we have no handicap access ramp in front of the building and mgmt is always putting some type of restriction on the tenants to otherwise squelch the living experience here…

IS it right for landlord to sign lease then have son which lives upstairs be the one to call in emergency. Have a problem with gas regulator in natural gas stove and have mentioned more then once. When I called the landlord about it and also the breaker flipping son got upset and told me not to call his father call him. Is this a matter I should be concerned about if it comes to be a problem? They asking me if we renew our leasing contract if not, they were asking to reply advance 60 days if we moved out, almost only a days given us to decide and to look for other housing which really imposible to do because of processing and and other requirement to complete before we can move in.

I live upstairs in a private house that I lived in for 11 yrs. The landlord passed away Sept 2006 and now her brother lives downstairs. He all of a sudden wants to rip out my bathroom which he saw about 2-3 yrs ago which needed fixing since I moved in there. He tells me on Monday, Sept 17, 2006 that he wants it ripped out on Wed, Sept 19. The brother said he put plastic to cover the livingroom and kitchen combo and the bedroom but I know that will not happen. Just today he gets cable installed and had mine disconnected by the man who installed it and I pay for my own cable. I don’t trust because when his sister lived downstairs she had 3 men break into my apartment when I was not home to put in 3 out of 5 new windows and they trashed the bedroom where 2 windows went in with the old window frames all over the beds and glass all over the floor. In the bathroom where they put another window one man purposely dropped the old window and glass all over.

I live in Texas. Everything was ok in the beginning but the apt’s have gone to S*** whithin the past couple months. The main entry gate with private combination has been stuck open for months, there are huge potholes all over the drive, it is almost impossbile to drive through without hitting more than 2, and now, the property owned street lamps are not being changed out, leaving the place pitch black at night. The cops are ALWAYS here for something and even shut down the complex for 7 hrs once. And I’m pretty sure I live next door to a drug dealer. I don’t feel safe and want out. Anything I can do?

Yes, landlord can show the apartment from the day you give notice, unless you are willing to pay rent until it is re-rented after you move out. Landlord must give you reasonable notice of a showing, like an hour or two, so you can clean up, put on clothes or whatever you want before people parade through.

Yes, three days and you better get your stuff out, or landlord can lock you out and sell your stuff to help pay whatever you owe. They do NOT have to put your stuff on the curb.

Recently I have had a change in income level ( work is slow I am a real estate Appraiser) So in searching the internet for cheaper rent I found my apartment complex advertising my model match apartment for $269 less than my rent. When I approach the management. They tell this rent is available through some type of bond from the city, All need to do is show the change income level and they will lower my rent. I provided them with what they asked for,a check for the lower rent, they cashed it. And because they dropped the ball and didnt get the bond approved are threating eviction.

I been notify that i must start paying a guest fee becuase my wife did not pass the credit check.I originaly moved in with my 3 year old an myself on the renters agreement. I informed them that my girlfriend was staying with me and they said she had to fill out an application. she was denied because of her credit. So they said i must pay a guest fee of $100 dollars. And I recently signed a lease given to me by the landlord.
The owner had not signed this lease when it was passed to me.I signed it first and it was to be sent to her to sign.With the lease signed by me, they excepted 12 post-dated cheques,100.00 cash tward the hydro, and passed me the keys.
As I am loading my truck to move.
The landlord changes her mind and decides not to rent it out!!.
Can they do this…just change thier minds or do they now have to follow the lease and give me proper notice??

i live in an apartment with my husband and my 6 month old son. everyone in the complex has just been asked to fill out a reavaluation application to continue to live in the complex. In the application it asks us to give our bank account numbers, and even our son’s education account number. Its my understanding that in leases it states that anyone who is not on the lease and stays for a period of more then 2 weeks is considered a break in the lease and the tenants can be kicked out without getting their deposit back.

My friend wants this guy out but hes claiming he now has tenant rights. I think he’s wrong. What rights does my friend have as a real tenant on the lease?

I moved in 7/1 and the landlord has yet to split the utility meters. AFter trying to get her to fix the heat for 2 months, I paid it myself to fix it. We have had 2 cancellations for the electric due to the meter issue and now it’s getting ready to be turned off again. She has a huge bill that is for the whole house and basement and won’t separate it so I can put in my name. There is a sanitation violation on the front door for the dirty exterior of the house. I told my landlord I was deducting $350 x 2=$700 for 2 months without rent and time taken off of work to get the heat fixed/sickness, as well as $35 for a space heater and she can keep my deposit and I’m moving out April 1. She said I could talk with her attorney that I have no right to break the lease or deduct any money. Advise please.

I live in a third floor apartment & have requested to move to a first floor. I have health issues that are aggravated living on the 3rd floor. I have Cardiac, B/P, and Asthma issues. To move to a 1st floor they want to charge a transfer fee or $150.00 for the transfer, $80.00 for a transfer to a larger, or smaller apartment & a new application and application fee for everyone in my apartment over 18 yrs. Recently my apartment was “pre-inspected” w/out my consent or prior knowing and i got a note on my door 2 days later that i needed to removed the “chains” off my doors because i am violating the lease agreement. I am a single female and live alone and do not feel safe without those on my doors.esp. at nite. do i have any legal rights to keep them on?? Read your lease if it does not specify a fine, tell them “where in the lease does it say that?” it has to say the amount of the fine. If they insist let them fine you, when they do tell them you are breaking your lease because they breached their contract and If they sue or put it on your credit you will sue them for breach of contract. They do this because of all the yuppies out there who don’t know the law. Unless it is stated in your lease they cannot.

5/14/08 I would like to know if there is a credit check also on Landlords background before you move into the place. Many times you move in and then you find out something is wrong, etc. And then your stuck in the circle. In this case this landlord does not want to repair and is slow to repair the washer/dryer, refergerator, windows, etc. There should be a starr next to each landlord as to how their reputation is in the past and now. Just like checking out the restaurants and give them a score. That is what they should begin is look into the landlords background history and give Starrs. Thanks.

I MOVED INTO AN APARTMENT IN JANUARY OF 2008 AND IT WAS COLD AT THAT TIME SO I NEVER BOTHERED TURNING ON THE A/C. NOW THAT IT HAS BEEN IN THE UPPER 90′S TO 100′S I TRIED USING THE A/C AND IT DOESNT WORK. I TOLD THE MANAGER ABOUT 4 TIMES ALREADY AND ITS GOING TO BE A MONTH SINCE I TOLD HER. i was supposed to be renting an apartment starting june 1st. when i first looked at the apartment i was told all nail holes would be filled, it would be freshly painted and also cleaned. i received the keys a month later, after i signed the lease and was told i could move in anytime. i went there this past weekend and nothing was done to it. it is filthy dirty, no painting was done. nothing was done to it. i called and left a message to the manager. she was very rude and said if i was so picky i should have said something when looking at the apartment. any way i can get out of this lease in 5 days time?

I rent an appartment in WA state. A significant amount of humidity introduced into this small bathroom space has caused the wood molding at the base of the wall to swell. The fan works, but to what extent it exhausts humid air I have no idea. Can it be assumed that the landlord has to repair this baseboard?

We are planning on moving into an apartment tomorrow. We did the walk through and the apartment was fine except for a few minor things. Sounds like you have a crooked manager. He or she is pocketing the money and doesn’t want the owner to know about it. You need to find out who the owner is and tell them of your situation and suspicions.

Hi everyone. I have been living in a townhouse for about a year and a half. In that time, I have had sewage back up into my downstairs living room from the adjacent bathroom a dozen time or so. I can’t get them to do a proper job in fixing the conditions I and my children are living in. There is also mold growing in all the ac ducts(they spray painted the vents when I hounded them for weeks to get rid of it). I know what has to be done if you get sewage in your carpet and they’re not doing it. I am moving but am afraid of getting sued for not giving 30 days notice. My mother was on a waiting list for 18 mos for an apt. She’s retired and is relying on Soc.Sec. alone. She got a call from the apt she was waiting for, filled out a new app. and was approved. She paid the deposit and was given a move in date. She gave notice to her present landlord to vacate the old apt & started packing. I have been charged a fee for repairs of a wall in the unit downstairs that was destroyed “allegedly” by my air conditioner. I purchased the A/C in at the end of June and the damages were reported mid august. The A/C that I purchased never cooled down my apartment so I always used the fan option. There is a huge gap in betweeen wall and the floor due to improper wall formating. When I saw the dagmage the contracter told me that I could not hire someone for a second estimate and that I was responsible for the damages because of the water leak. I sold my house for personal reasons the new owner rented to house back to me and my husband, I moved 2 days later, my husband stayed for 3 months but did not pay the rent, the new owner filed an eviction on me 2 months in a roll which people said they never heard of filing one month then going back and filing the next month,but anyway are there any apts out there that will rent to me with those evictions on my credit report even though they are for the same place? Help! Our apartment’s handyman set fire to the apartment next to us! There was a HUGE hole between there apt. and ours… we could see right in to their bathroom! They fixed the hole as far as putting up new drywall and taping and mudding it… but that’s it… they have not fixed the floor, trim, or repainted. I moved to Florida with a friend of mine June 2008. Both of our names were on the lease. One night she got arrested for underage drinking that had nothing to do with me. The next morning I receive a call saying we are both evicted and have 7 days to get out. I never received a copy of my lease until a month after I’m evicted and a month later they send me a bill for $2178 for early-termination fees. It only says we must pay for the non vacated months and no early-termination. The are only going after me, do I have a leg to stand on?

One of my guest slipped on the ice that was not cleared off the side walk early Dec. 2008 and had suffered severe pain from he sought out medical attention and was given pain killers and sent home. One month later the pain returns and he is in excruciating pain, unbearable he seeks medical treatment again this time from a Chiropractor and his family physician. He now has to have an MRI to find out the problem which could involve surgery. Can the owners of my Apt complex be held liable for not posting signs or not applying any ice melters in a timely fashion. They take days sometimes a week to clear our sidewalks here.

One of the occupants (above) was a previous coworker of mine who got laid off for disrespecting the boss. Hello, someone attempted to break into my apartment a week ago and the cracked and broke the bottom of the door. I had to call the maintenance people over 4 times to come fix my broken door, when he came to fix after hours he refused saying we broke the door. I reported him to the office, corporation and the better business bureau for not caring about my safety and leaving with a broken door for over 2 nights. I finally got a call back today (week later) asking what happened. She never listened to my story and told me they would charge me because I never filed a police report. I felt unsafe can they do that?

hi, about seven months ago someone broke into the office of the apartments where I live in and stole a couple of rent payments (including mine) and were forged in order to be cashed. A police report was filed and there is proof that the checks were stolen from the office and cashed. a few months later the manager wants to make me pay for the rent of the month that the check was stolen. I don’t have $1,000 just laying around. Can the manager make me pay that money if it was stolen under her care? Is it legal?
