Questions to Ask Before You Sign a Lease

(Rate this article)

Use this handy Apartments.com checklist when you’re visiting potential new apartments.  The landlord should be helpful and should not hesitate to answer these questions or to put the answers in writing.

1)  When is rent due?

2)  Are there penalties for late payments?  What are they?

3)  How long is the lease?

4)  After the initial term of the lease, will I need to renew for a year or will I be able to lease month to month?

5)  What are the lease breaking fees?

6)  Are there any application fees?

7)  What utilities are included in the rent?

8)  What is the approximate cost for utilities that are not included in the rent?

9)  Are there any costs for setting up the utilities that are not covered in the rent?

10)  Is parking included in the rent or are there any additional parking fees?

11)  Where is the parking area?

12)  Is there a pool?  Can it be used by anyone?  Are there any additional fees for using the pool or gym area?

13)  How big is the hot water heater and is the hot water heater shared with any other apartments?  (This is a relatively important question, if there is a small heater, or if there is one shared with your neighbor who likes to take hour long showers right before you have to get up, you may end up taking cold showers more often than you’d like.)

14)  How much is the security deposit?  How much of the deposit is returned at the end of the lease?  What will prevent me from getting my security deposit back?

15)  How long is the lease?

16)  Is sub-leasing allowed?

17)  What happens if I accidentally break an appliance?

18)  How is routine maintenance completed for the unit?  Are maintenance people on call 24 hours a day?  If not, who should you call if there is an emergency?

19)  Am I allowed to paint the walls?

20)  Am I allowed to hang pictures with nails?

21)  Am I allowed to have overnight guests?

22)  What are the procedures if I decide to have a roommate at a later time?

23)  Do you require renters insurance?

24)  Are there any noise level restrictions?

25)  Where are the smoke detectors and do they work?

26)  If there isn’t an in-unit washer and dryer, where is the laundry and what is the cost?

27)  Can you get cell phone reception inside the apartment?

28)  Am I allowed to have pets?  If I don’t have one now, and I get one at a later date, will my lease change?

In my first apartment I was robbed after 2 mths. of residing there. I strongly believe it was a maintenance worker because the person tried to enter my apartment while I was home one day and he/she had a key. I reported it to the landlord and she offered to change my locks. I still didn’t feel safe because maintenance always has access to an extra copy of a tenant’s key so I refused because I knew it was maintenance that broke in because no one else had a copy of my key, NO ONE! The next day that person returned while I was at work & broke into my apartment and stole my belongings. What rights can I exercise as a tenant to prevent this horrible crime from occurring again?

I would buy a nanny cam and hook it up to my VCR, point it at the door and let it run all day. THEN, you have the video evidence that you need to go to the landlord and the police.

You cant say it was the maintance person for sure. Have you ever took a moment to think that maybe it was the people that lived there befor. They never change out the locks so all the people that lived there befor could have broke in. Dont always jump the gun and blame the most obivious. Look outside the box and use your brain.

Most Landlords change the locks just for that reason. Make a police report and if you can afford it, rental insurance. Check your rights as a tenant for the state you live in and talk to your landlord to express safety precautions.

try to find a friend that you trust and like, who is willing to help you pay or if you prefer to live by your self or get a protective dog, you may need to save your pay checks for a month or so, if your trying to get into a place by yourself

Tatyana: I have been living on my own for a few years now. The main thing that you really should worry about is your safety. I have lived on the 1st floor of an apartment building for about 2 years now and was broken into once. It was a really nice neighborhood and everything, so I probably didn’t take as many precautions as I should’ve. Being aware of your surroundings is a main thing. Don’t leave your blinds open at night or when you aren’t there. That was my problem I think. I don’t know where you live but just try to get the best for your money. I am moving to a higher up floor to feel a little safer. My main wants for an apartment were central air, a dishwasher, laundry in the building, allowing pets; but figure out what you want and can and can’t live with. Some apartment complexes will pay some of your utilities, so that would save you some money as well. You’ll have to do some hunting and looking at apartments, but eventually you’ll figure out which is your best bet. Hope that helps!

Change your own locks and don’t let anyone see you do it and don’t tell the landlord. Do it when you think its safe, when no one is around or move out. I always change my locks upon moving in first week in fact. Try it and tell the police you seen the man who you think broke in. Its your word against his word and your word rule. You have to see it in order for the police to believe it. Make it sound real

As a tenant you do have a ownership interest, and no judge anywhere is going to let you deduct anything if it is put back before a tenant moves - learn the law dumbass!

I agree with you as well, as long as the locks are replaced, no lanlord/owner, has the right to charge anything (unless, its in the lease).

Thats the problem, so MANY landlords, dont realize, that tenants have more rights than they think!

It is the two of you who need to learn the law…in most states you are not allowed to change locks yourself. And if you do, you still are required to give the landlord a key. It is their property, not yours. You RENT, they OWN. See the difference? At my apartment community, if a resident changes a lock they are REQUIRED to give us a key, if not, we will go in and change the locks ourselves and then pass along the charge to them. Michelle, it is you who sounds like the dumbass. Not only do you not have a clue what you’re talking about, you’re rude.

Michelle, I agree with you and changing the locks. I had an incident happen in my apartment in Los Angeles and I had the police over. It’s a long story but the landlord had something to do with the breaking in of my apartment. The police told me to change the locks and not give a copy to the landlord.

Regarding Miranda, like a lot of landlords you seem to have a bit of an anger problem. Settle down.

Haley, it is you and several others posting here that really do not know what you are talking about. I have been a manager in several states and the law has always been the same. Management changes locks and gives you a copy. If the resident changes the locks and does not turn over a copy to management we can serve you with a 48 hour notice to give us a copy or we will change the locks (at your cost) and the resident is required to come to offce to pick it up.

Although residents do have rights, there is never a need to be mean or nasty, sometimes your interpetation of the law is not what the real law is.

LANDLORDS CAN’T TAKE THE SECURITY DEPOSIT FOR DAMAGES OR CHANGED LOCKS. The SECURITY DEPOSIT IS THERE FOR THE LEGAL PURPOSE OF GUARANTEEING THE CONTRACT IE: RENT PAID LATE FEES UNDER NO CICUMSTANCE MAY A LANDLORD DEDUCT DAMAGES FROM YOUR SECURITY DEPOSIT! If they do SUE them if they claim damages they must file a legal claim and a court must decide if they have proven the damages but they cannot take it out of the security deposit.

Changing the locks is a violation of the lease, as the landlord sometimes needs to enter for a maintenance emergency, or routine maintenance, with notice.

Changing the locks is not really an option without getting the landlords approval first. this could cost you a lot of money in fines and compensations. Not to mention getting evicted.

In New York City everyone changes their locks. Landlords can’t even get in to evict people without going to court.

If you can’t change the locks at least ADD a second lock like I did.

In the state of Florida if you are renting month to month the landlord can make you be physically out 15 days of the notice. I am a realtor and homes that I have sold that had tenants on to month
to month agreements are subject to rent increases and any other changes in the agreement as long as it is considered reasonable by the average person. THAT IS THE LAW IN FLORIDA. Take heed so you don’t get surprised if the home/apt is sold.

DO NOT change your locks without landlord permission. If you’re that worried, live in a safe apartment complex or install one of the chain-type locks for when you’re home. It’s a huge safety concern and can lead to you getting evicted, in addition to the apartment complex blacklisting you.

Also, from a legal standpoint, filing a police report is a good idea. However, lying about what you did/didn’t see amounts to a false police report, which is against the law and could result in you getting arrested.

I just signed a lease in December,2006. Because my landlady is selling her house I would like to move out—fearing that whoever purchases her house will evict me. call your light company and they will come read your meter when your at home and check to make sure everyone lights is separate and ask them to tell you if they have a light box for the common areas for example hallways outside your apartment because some landlord will hook the common areas up to your meter box

I started renting in August and signed a 6 month lease which ended on the 20th day of Feb. 2007. I called the office to renew our lease for another 6 months instead of receiving a renewal I received a letter stating I did not have to renew until August of 2007 which was an error on thier part because we only signed a 6 month lease. I was not able to respond to the letter to question the dates due to me being sick because I was pregnant and having my baby. In the mean time we found a house to rent closer to my husbands work (he is a National Guard Recruiter, in S.C.). We gave them a 30 day notice that we are moving out but now they are wanting us to pay a PRO-CAP FEE (a fee added to the month to month rent fee)since we did not sign a 12mth lease and our lease went to a month to month lease. In our lease contract it does say our rent will go up but it never says to how much and it does not say we would have to pay additional fees on top of the rent. Can they legal go up on our rent and make us pay additional fees if they have not given us written notification?

Actually it may not be just your business. Some apartment communities require everyone over the age of 18 to be screened and to be lease signers. If that’s the case where you will be living, and you sneak this person in and are caught, you are in violation of your lease and could be evicted. Also, there are some communities that won’t let convicted felons live in their community.

My son just got out of jail we told the apt. manager he may move in unless he can find someone to live with .She said she would leave the names off the lease until we were certain. He moved in,now they want us out. we went to a lawyer and he has got us out of our lease. He is disabled and since he went to jail lost SSI benifets. Please advise if you can… I live in an apartment where I had to transfer from one larger unit to a smaller one. While living in the larger unit, I never received a Lease. Now that I’ve transferred to the smaller unit, there are things that never was fixed before I moved in, but was promised that it would be completed. It’s now 8 months and no repairs, my kitchen is infested with Termites which I brought to the manager attention and all she has done was apply some gel to the areas and covered it up with clear tape. The termnite problem is to the point to where I can’t cook safely, because I have droppings all over the stove or the countertops. I don’t whether to report her or just leave since I don’t have a lease. Please point me in the direction of where I need to go.

First of all, I would have left long ago!Since you’re still there,you should video the problem areas and document each conversation that you have with the landlord regarding the problems, then…you should contact the local newspapers and news stations. My question is, if he gets into a leased apartment, lets say for a year and after 6 months his health fails and needs constant care, we may have to put him in a nursing home, what about the remaining 6 month lease? Have you thought about a month to month lease. You could also have a clause in your lease saying something about your fathers failing health and if he were to need assisted living that your lease would automatically terminate. You just have to get a little creative, be sure to get it inwritting somewhere on the lease.

Do you have a signed lease. What did you pay for the month of april when you moved in.(14april to 1may) Your lease should say how your rent is determined. My apartment has a day rate. For every day that I live there I owe a certain amount. This 30 bucks or so was added together making what my rent is per month, to a grand total to be owed the day my lease is up. Your apartment should not be charging you for a full month if you are only there for 14 days. The days in which you will be living there for are what you should owe. Unless your lease states otherwise.

Today, I signed a lease with a verbal contingency stating that I would be allowed access to the apartment to paint it this afternoon. The leasing agent was delayed, my paint crew threw in the towel after waiting three hours and the keys I was provided at the end of the day don’t work. I can’t access the apartment, my lease begins April 1, I rented a vehicle (which I have now) and I cannot move in. What rights do I have? So here’s the update… they gave me the correct keys late on April 1st, but the apartment could not be prepped. To accomodate me, the regional manager offered me a $100 refund. Rent on this unit is $1325.00/month. She also promised that she would have the paint crew in by this Saturday to complete the job. This afternoon, she phoned to inform me that the paint crew she has will not be able to get into the apartment until Tuesday, April 10th. Had I known this would happen, I would have signed an April 15th lease. Now I have a moving crew for this weekend and will not be able to unpack while they work until Wednesday. Did I mention that I work 70 hours in a hospital, to boot. I am completely fried at this point. Any lawyers out there wanna take a stab at this?

At this time I am currently living with my parents at there home. I never lived on my own. But I am strongly considering moving out sometimes next year and getting an apartment and have my boyfriend live with me too later on.

I have a pretty good paying job. I am a RN and work in a hospital with steady hours.
My main concern I want is security. I don’t want to feel maintenance staff or anyone else will break into my apartment when I am not home.

What advice anyone can give me on what I need to know on renting my first apartment?
Is living upper level apartments like example 2nd floor or 3rd floor better then living 1st floor?

this is a medical issue - see your physican and get a medical diagnosis stating that the smoke is negatively efficting the kids… find a new place to live and give the appropriate # of day’s notice on your current lease and GET OUT - your kids health isn’t worth staying, even if you do end up loosing the security deposit (worst case) - keep copies of the medical report for when looking at new places too so the new landlord understands why you are breaking a lease - GOOD landlords will not hold that against you

I need some help. I’ve lived in this aprtment for 2yrs. I’ve asked the landlord to check on my gas boiler cause my gas bills were very high and i wasnt even using the gas anymore and i had gotten a bill of over $400. He told me he would and a month went by and i got another bill of $350 so I called the gas compny and they told me i should call an inspector i told them i didnt know any and they gave me a number to call so i called and set up an appointment but i didnt know that they were with the city safety code enforcement.but anyways the point is the inspector came and found some violatons alot of them. They even found out the I was paying for light that belong to the landlord by law. So I called the lanlord up and told him he got upset because he claimed that the safety code enforcement department didnt know anything the first thing he rejectedto fix was the light problem. I spoke to someone from the housing and they told me that i can hold the rent until they fix the apartment, so i did they have to the 25th of may to fixeverything but thay havent even come by the apartment. But they sent me an eviction notice stating that i have to the 29th of may to either pay or leave the premises and now i dont know what to do because i am afraid that if i pay them the rent and they dont fix the apartment the inspector is going to come and close up the apartment and on top of this i have two kids 2 and 3yrs old can you give me an advice

Stay there at ur apt especially if u have children they can not throw u out. Do as the housing people said hold the rent. Save it though, so if worse comes to worse and u must move for violations on the apt by the landlord and it is a safety issue for u to stay then u will have money saved up for another place. The landlord if they want to evict u has to take u to court and they wont do that number one because they have violations against their apt bldg. i hope this isnt to late. and i hope u r ok now.

if you wasn’t serve by a coustable it not an eviction notice its a notice to quit only a judge can put you out your apartment the landlord have to take you to court first and as long as you have your rent in the bank and can prove that to the judge you have nothing to worry about and keep all your documrnts

Anytime you hold rent until a landlord fixes something to prevent evistion you need to put the money into escrow.

In reply to the lady looking for rent according to her income. You need to check into Section 8 in your area.
There is usually two types a voucher where you look for housing on your own and find a landlord willing to accept Section 8 OR a private landlord that rents according to income and they are reimbursed by HUD.
You can google HUD and find out what options are in your area

I moved into an apartment in jan. 2007 and I signed a one year lease. I was recently approved for my section 8 and I talked to my landlord about a problem i was having in the apartment with roaches and rodents and nothing was never done. I have no smoke detectors in the apartment neither. The board of health was called and the landlord was fined. I was holding my rent until he got an exterminator out, put up smoke detectors and make repairs in the apartment. Now he is suing me for non-payment of rent and he wants to sue me in civil court for breaking my lease because section 8 wouldn’t let me stay there. I have no problem paying the rent if the court makes me, but I feel he should be held liable for making the repairs and making the apatment safe. Anothe rthing is he doesn’t have a CO for the apartment. What could I do.

section8 got your back just infom them of what is trying to do and ask your housing for a letter for the judge about telling you to move out section pays the biggest portion of your rent so if he is taking you to court he must be taking ‘em as well tell your worker and you shouldn’t have to much to worried about you should be ok

Also they want to put the house on the market and I just signed another 6 month lease. Do they have a right to do that? I am about to move out of my apartment and into a new one. My old apartment had a few cosmetic issues with the stripping on the back door and a big cut in the living room carpet when I moved in. I am worried that my landlord might try and see these were things I did in order to keep my deposit. Is it normal that apartment managers should have a key to your mailbox? I don’t see what possible reason they could have to get into my mailbox. I should think there’d be some federal law prohibiting this.

My Landlord is using my personal mailbox on which she has even pasted her name. This bothers me and I have removed it twice, but she keeps putting it back. She has the keys and goes trough my mail before me.

The problem is I found an apartment in Roselle, NJ yet after signing the lease and writing a check for over two thousand dollars of which the apartment complex cashed the next day, I have no lease copy and no keys as promised. The apt complex owner refuses to discuss a roof water leakage & damage that the neighbors brought to my attention. Contact your local small claims court or whichever agency handles rental and landlord issues in your area. Document the problems (photos of the leak, etc) Contact your bank and retract payment. Most FDIC insured banks are able to do this within 21 days of the check being paid.

I am on a cosigned lease with someone until Jan 31, 2007. The apartment is $650 including utilities. We each pay $325 a month. Actually I think her mom pays her half. I don’t plan on signing another years lease with her after this lease ends. If she wants to stay there but can not find somebody to cosign with her, is in school, but does not have a job, can she still live there? Would her mom have to be responsible for the full amount. I have heard that if 2 people are cosigning , if one person decides not to renew the lease that the other person might not get to stay there unless they can find somebody else

I am looking into getting my first apartment within the next year 18 months. I am not getting a house, but would love to, but resale market is horrible. With an apartment am I free to make changes to the appliances, paint, tile, add hardwood,etc.? If not why? This would increase the value for the landlord, and he could jack up the rent in the future with someone else. Has anyone heard of anything like this?

I moved in with my elderly mother in her apartment when she got it. She could only live there if I lived with her as her caregiver. We have lived there for over 3 years. The apt manager agreed to let me live with her as her caregiver. I was not put on the lease and did not pay rent. My brother is her POA and he paid the rent with mom’s money. I lived with her and took care of her in kinda an exchange for her to not have to be put in a nursing home. My brother put her in a nursing home & closed the apt. The apt manager locked me out 7 days later. Wasn’t I a tenant and this lockout illegal. Don’t I have rights?

Do you have any proof that the landlord knew you lived there? If not, you have no rights becuase you are not on the lease which is probably in violation of your lease agreement.

Read your lease, please, it’s long but do it, second, the only way not to pay rent anywhere is to pay the courts and tell them the reason you don’t want to pay the landlord. The reason better be good, real good. I you lie on the application, even if they didn’t do a backround check then you can be kicked out. If you let someone live there not on the lease, you can be kicked out. Have pets? Better be careful you can be kicked out if you have more than on the lease. If you can’t afford the housing, get into rental based housing, look at the apartment you are going to rent, I know this was stated before but this is true

More important info, do a backround check on the apartment community, you can do that online. Check that it is current information and take it with you and that you read it online…They hate bad press but get it all the time. The place I am living had it and I didn’t read it first, or I would have known about this place before I moved in. It is bad. Spa has never worked, front gates don’t work, cars broken into all the time, drug dealers, nasty apartment, I was shown model. Pool bathrooms arent’ open and people pee on the property, you better check well. Do it for your sanity and don’t fail to look all over.

I have an apartment manager who is watching everything through binoculars and has a camera facing the sidewalk. My daughter has a few friends that visit and i have some tat visit but the apartment manager thinks he can decide who i can and cant have over. he calls the police when some of my guests come over and tells them they are not allowed on the property. This is my first apartment and I caught a special to move into this apartment complex with no app.fees, just a dollar to move before February. I was told I could move in the weekend of 1/25 but no one called me, so i went by and she gave me a move in date for Friday 2/01. We moved in May– immeaditally we noticed several things the landlord had tried to “hide” Small things like conviently placed magnets on the fridge to hide big dents, and carpets around the toliet to hide water stains. Make sure that you notice these things BEFORE you move in. We move out in June and can only pray he will give us deposit back.

Also we had no hot water for one month. I live with a plumber and landlord yelled at him and did not fix problem. He contaminated the water with HCl — so it was unusable for a week.

The front door does not lock properly either.

Make sure you pay attention to details!

My boyfriend and I recently became engaged & basically moved in with me. I received a phone call from my landlady today that if anyone wants to move in to the apartment he has to go thru the entire application process.

However, the previous tenant told me that she rented the apartment for her parents and they only ran a credit check on her.

I am going to have a lease with a friend to share a 2 bedroom/ 2 bath apartment. Rent is $1,000 a month, split to $500 each. The landlord is already knowledgeable of our agreement and is fine with it. We both have our parents as cosigners.

I now have a question. I know that we can have up to 4 people in a 2 bedroom apartment. I have a friend who in the future will need a place to stay. How do we go about adding this 3rd person to the lease in the future? Or can I have them just move in? Do they need a cosigner if they are over 18 with a full-time job?

Do your homework before signing a lease. Check out your local police reports in that area before moving in. Drive by at night and day time before signing. Don’t jump to sign a lease, make sure you feel safe, secure and all terms were met on your document with the leasing office. MLO
